Definition

The following definitions have the same meaning whether they are singular or plural.
« Guest » means a customer who reserves and/or books one or more Services offered on the Website. 
« WhereInRio » - means WhereInRio Imobiliaria LTDA, whose registered office is at Rua Farme de Amoedo, 80 B, Ipanema, Rio de Janeiro under the legal number CNPJ 12.301.766/0001-95 and CRECI CJ 6820. 
« General Terms and Conditions » means these general terms and conditions for booking and use, as amended from time to time.
« Service » means an accommodation service or other services.
« Owner » means the owner of an apartment offered for rent.
« Websites » means the www.whereinrio.com 

Restrições

A few specific restrictions are noted below. A complete listing of terms, conditions and 
policies will be sent to you in the Rental Contract.  
-  Occupancy numbers are strictly enforced.  
Do not exceed the maximum allowed number of occupants in a property.  
-  House parties, and large unapproved gatherings are prohibited.
-  Pets prohibited in Non Pet Friendly properties.
-  Must be 21 years of age or older to enter into Rental Agreement

There is a 4 nights minimum for advanced bookings on all properties. 
Many properties have higher nightly minimum stay rules during the high season and peak periods, such as New Years and Carnival - see individual property listing page for details. 

 

For advanced bookings of 2 or 3 nights there would be a 4 night charge applied. 

 

WhereInRio may make exceptions to the 4 nights minimum stay rule, if requested by guests, and at WhereInRio’s sole discretion if they are able to offer this exception.

Minimum stays

Guests will be met directly at their rental property by a member of the WhereInRio team, for their official check-in. 

 

Check-in time is after 3:00pm, Check out time is no later than 10:00am. 

 

We must strictly follow designated check-out times in order to prepare property for the next Guests; the times are not flexible and overstaying check-out time will result in a minimum over-stay charge of 50% of the nightly rate if guest stays past the check-out time of 10:00am, and one full day rent if guest stays past 3:00pm. 

 

In some cases WhereInRio may allow the guest to check-in early, or check-out late, but this is strictly done on a case by case basis, and does not in any way over ride or supersede the check-in and check-out policies and fees stated above. 

 

If Guests arrive before their 3:00pm check-in, they may come directly to the WhereInRio office (address provided in rental contract) to leave their luggage until check-in. 

 

Guests may request an early Check-In no more than 24 hours in advance of arrival or late Check-Out no later than 24 hours in advance of departure. If the guest reserves an early check-in or a late check-out up until 6:00pm, there is a half day rental charge. 

 

Any check-ins or outs before 8:00am or after 6:00pm, during the weekend and Brazilian bank holidays are subject to an additional 200,00 R$ fee. 

 

Upon request by the guest, WhereInRio may allow for early check-ins or late check-outs, if the situation allows, and/or if WhereInRio grants this exception. 

 

As well, in the case that there is an existing reservation before the guest finalizes their booking, and the existing reservation has paid for an early check-in or late check-out, the new reservation of the guest may be subject to later check-in times, or earlier check-out times. This will be communicated by WhereInRio to the guest before they complete their booking.

Check-in, check-out 

After reserving a property with WhereInRio, Guest will receive an email confirmation of the booking and then separately your Reservation Confirmation - Rental Agreement and Policies. 

The Guest will need to review and sign the contract within 3 days from the date the reservation is made or 24 hours if the Guest's arrival date is within 15 days. 

Guests will also receive an email from WhereInRio, which will provide them with valuable information about their rental property and reservation, and allow for easy communications between the Guest and WhereInRio.
 

Reserving your stay 

Payment Terms

Reservations require a minimum 35% non-refundable reservation deposit (35% of Guest’s total rent due) at time of booking. During the peak weeks of New Years, Carnival, etc, a non-refundable reservation deposit of 50% is due at time of booking. 

 

The balance of 75% is due at or before check-in (or 50% in case of New Years, Carnival peak period booking is due at least a month before check-in). 

 

Guests will be allowed to enter the rented property, and keys will be released to the Guest, once the balance of rent has been collected by is due at or before check-in. 

 

If the Guest chooses to release their reservation for any reason, prior to paying the remainder of your initial payment, Guest would forfeit the initial non-refundable reservation deposit. 

 

WhereInRio accepts Visa, or MasterCard, American Express (with an extra of 5%), as well, WhereInRio accepts direct bank deposits to our company bank account, and cash payments. Bank fee may apply up to 80 USD.

 

If Guest chooses to pay by bank deposit, WhereInRio will provide Guest with full and complete banking information, and Guest will advise WhereInRio once they have processed the deposit.

Security Deposit

For every reservation the Guest will need to provide a security deposit. The value of this security deposit will depend on the specific property which has been rented, and the size and structure of each Guest’s group. 

 

The security deposit will be held by WhereInRio as an authorization on the Guest’s credit card (Visa or Mastercard only), and will be released within 2 weeks of Guest’s departure from their rental property. 

 

The credit card authorization is valid for 15 days, so if the Guest’s stay is over 15 days, WhereInRio will need to re-process the security deposit authorization during their stay. 

 

The cost of any damage to the property or to any items in and/or at the property caused or any service charges incurred by Guest or any member of Guest’s party (for example telephone calls) will be deducted by WhereInRio from the security deposit during, or, at the end of the Guest’s stay. 

 

If no deductions are required the authorization held on the Guest’s credit card will be released. 
If the security deposit is not sufficient to cover any damage caused or service charges incurred by the Guest, the Guest will be responsible for paying WhereInRio any additional monies required immediately on request.

Guarantee

Guests are required to provide a credit card number as a guarantee.  

Guest Services Fee

A non-refundable Guest Services Fee/Booking Fee of 200,00 R$ is required for all reservations at the time of booking. The non-refundable Guest Services Fee includes but is not limited to: 24-7 emergency assistance, free after-hours lock-out services, and free WIFI access. 

Housekeeping and Linen

For every booking, WhereInRio provides one (1) weekly cleaning. 

 

For some specific properties, or if guest as specifically requested, more than one (1) weekly cleaning may be included with the rental of the property. In these cases, this will be agreed upon before the guest completes their booking, and will be noted in the Rental Contract which WhereInRio will provide to the guest. 

 

WhereInRio - provides a basic supply of bed and bath linens in each property (sheets on each bed, 1 towel and 1 wash cloth per person up to the property capacity, and hand towel(s) in each bath). 

 

These towels and linens will be changed weekly. If the guest requires more frequent changing of towels and linens, many of the properties feature washing machines which our Guests can use, or WhereInRio does offer a laundry service, at an additional charge, which is dependent on the amount of laundry. Beach towels are not provided.

Pet Policy

No Pets are allowed in or on the premises unless WhereInRio has expressly authorized such use (type and weight of dog must be listed on lease and non-refundable fee(s) paid. If WhereInRio does approve a pet stay in one of their properties, Guest is responsible for cleaning the area around property of all pet excretions and removing pet hair from inside the property and all furnishings prior to departure. 
In the event of additional cleaning or laundering services due to pet hair, WhereInRio will bill Guest for the additional housekeeping costs. PETS ARE NOT ALLOWED ON FURNITURE OR BEDDING. 

Right of Service

WhereInRio reserves the right to refuse service to anyone. All rental properties are leased without regard to race, color, religion, sex, national origin, handicap or sexual orientation.

Maximum Occupancy 

WhereInRio has set and published occupancy limits for every unit and strictly enforces these limits. If a Guest exceeds these occupancy limits, WhereInRio may enforce it’s right to have the Guest and their group leave the property immediately, with all monies paid and security deposit held being non-refundable.

Rental Property Use

WhereInRio rents properties for individuals and groups according to the maximum occupancy and suitability of each Guest for their property. 
Absolutely no house parties, events, receptions, or large gatherings are allowed. 
Only those Guests whose names are on the lease may occupy the rental property. 
Excessive noise, overcrowding and unapproved Guests may result in the Guest’s expulsion from the rental property, with all monies paid and security deposit being held being non-refundable. 
WhereInRio represents a few properties which will allow a small family gathering. Such gatherings must be approved prior to arrival and require an additional fee.

Cancellation Policies & Fees

Once a reservation has been confirmed by payment and the Guest is unable to fulfill their obligation to occupy Rental Property, WhereInRio must be notified as soon as possible. 
We require all cancellations be in writing for protection of the Guest. WhereInRio will make every attempt to re-rent the property once we have received notification of cancellation. 
If we are unable to re-rent the property, no refunds will be due. If the property is re-rented at full Rental Rate, Guest will receive a refund of the full amount of rent consideration (Rent, Taxes, Housekeeping Fee, and Guest Services Fee less any “lost” days that WhereInRio was not able to fill) less a 500,00R$ Cancellation Fee.  
It is not WhereInRio’s responsibility to find a new Guest for the cancelled reservation. This will be attempted to be done by WhereInRio on a best effort basis, but Guest will not hold WhereInRio responsible if a replacement Guest cannot be found for Guest’s cancelled reservation.
In the following cases WhereInRio can cancel the rental contract before the trip or at any time, before or during travel; if the Guest continues to unreasonably disturb the implementation of the booking despite express warnings, or when Guest breaches the rental contract, so that immediate termination of the travel contract is justified for objective reasons. 
If WhereInRio the contract for this reason, WhereInRio shall remain entitled to the cost of the trip, with the rental amount paid by the Guest being non-refundable.

Changes

WhereInRio will inform Guests immediately of changes to their rental arrangements. Changes to the travel contract that become necessary after the contract has been concluded and are not brought about by WhereInRio in bad faith, are permitted insofar as the changes are not significant and they do not affect the overall character of the trip booked. 
The same rights apply to the altered arrangements as applied in respect of the original arrangements.

Force Majeure

WhereInRio regrets that we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by or you otherwise suffer any damage or loss as a result of "force majeure". 
In these Booking Conditions, "force majeure" means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.

Travel Protection, Trip Cancellation Insurance

WhereInRio highly recommends that the Guest obtain and contract a form of trip cancellation insurance in order to protect their vacation investment against injury, sickness, job loss, or death and other unforeseen covered circumstances, which could cause cancellation of confirmed reservation and forfeiture of payments.  We recommend that all Guests purchase this coverage for added financial protection in cancellation situations where we are unable to refund payments. 

Listings and Pricings

Guests are responsible for reviewing the property description, photos, location, and amenities listed online for this property to confirm that it will meet the needs of your group.  Information regarding individual listings is believed accurate but cannot be guaranteed. 
We have made every effort to ensure that all the information on the website is current and accurate.  The possibility of errors and omissions exists.  We will be happy to confirm all data contained herein or answer any questions you may have prior to booking your reservation. 
Rates for holidays, special events, and weekends may be higher.  Rates do not include tax and are subject to change.  Rates, furnishings, fees, and taxes are subject to change without notice. Prices on the website are shown in USD, R$ and EUR. Any price in another currency is for information only.

WhereInRio serves as the agent & representative of all owners of vacation properties in its rental program, and is acting at all times, in and for the best interests of the owners.
